Recon Weather (the "Service") is operated by Recon Weather ("we", "us"). These terms apply when you use the app, the website, or anything else we publish under those names. If you do not agree with them, please do not use the Service.
Recon Weather is not an emergency service and must not be your only source of warning. Always follow the National Weather Service, your local emergency management, and any official instruction you are given. Keep a NOAA weather radio or another independent alert source.
Weather data reaches you over the internet, through servers, a phone and a mobile network, any of which can be slow, wrong or down. Notifications can be delayed, duplicated or not arrive at all. Radar has gaps. Forecast models are estimates. A severe weather warning can be issued for where you are and never reach this app.
Do not use the Service to decide whether it is safe to be somewhere if you have no other information. If you are in danger, call your local emergency number.
You must be at least 13 years old to use the Service, and at least 13 to create an account. If you are under 18, use it with a parent or guardian's knowledge. You are responsible for anything done through your account, so keep your password to yourself.
You give us an email address, prove you can receive mail at it, and choose a password. Keep the address current, because it is how we reach you about the account. You can delete your account from inside the app at any time, and doing so removes your profile and signs out every device. Some content you posted publicly, and records we are required to keep, may survive the deletion of the account itself.
We may suspend or close an account that breaks these terms, that is used to harass people, or that puts other users at risk.
Storm reports, photographs, video, chat messages and anything else you send are yours. You keep ownership. By posting you give us permission to store, display and distribute that content inside the Service, and to show it to other users, including on the map and in the chat room. You also let us crop, resize, transcode and caption it so that it works on the different screens the Service runs on.
Only post what is yours to post. Do not upload someone else's photograph, video or writing without their permission.
We may edit a report's classification. If you send in a shelf cloud labeled as a wall cloud, trained staff will correct it before it reaches the map. That is a feature, not a judgment, and getting it wrong costs you nothing.
Do not use the Service to:
We moderate. Content may be filtered automatically or removed by a person, and accounts may be muted, suspended or banned. You can report content from inside the app, and you can block another user. We aim to look at reports promptly.
Chasers broadcasting on the Service are showing you real weather in real time. What appears on a live stream is not reviewed before it goes out. If a stream shows something that breaks these rules, report it.
Do not chase storms because you saw one here. Storm chasing is dangerous and you do it entirely at your own risk.
Warnings for where you actually are require your location, and you control that in iOS settings at any time. If you turn on the chaser beacon, your position is shown publicly on the map while it is on. You can switch the beacon off, and doing so removes you from the public map. See the privacy policy for what we store and for how long.
Observations, warnings, outlooks and model output come from the National Weather Service, NOAA, the Storm Prediction Center, the Weather Prediction Center, the National Hurricane Center, Environment and Climate Change Canada and other public sources, along with our own instruments. Public agency data is used under their terms. We are not affiliated with, endorsed by, or speaking for any of them, and nothing here is an official product of theirs.
Maps are rendered with Mapbox and are subject to Mapbox's terms.
If we offer a paid feature or take a contribution, the price and what it includes are stated at the time. Purchases made through the App Store are handled by Apple and refunds follow Apple's policy.
The Service is provided "as is" and "as available", without warranty of any kind, express or implied, including any warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted, timely, secure or error free, or that any weather information in it is accurate or complete.
To the fullest extent permitted by law, Recon Weather and the people who work on it are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data, goodwill, property, injury or life, arising from your use of or inability to use the Service - including any reliance on weather information, a notification that did not arrive, or a position shown on the map. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the twelve months before the claim, or fifty United States dollars.
Some jurisdictions do not allow these limits, so parts of this section may not apply to you.
You agree to indemnify Recon Weather against claims arising from content you post or from your misuse of the Service.
We may change these terms. If a change is significant we will say so in the app. Continuing to use the Service after a change means you accept the new terms. The date at the top of this page is when it last changed.
You can stop using the Service and delete your account whenever you like. We can suspend or end your access if you break these terms or if we have to stop operating the Service. The sections on content license, warranty, liability and indemnity survive the end of your account.
These terms are governed by the laws of the State of Wisconsin, United States, without regard to its conflict of law rules, and the state and federal courts located in Wisconsin have exclusive jurisdiction over any dispute.
